Terms and Conditions

1. Scope and definitions

(1) These Terms and Conditions apply to all contracts concluded via the online shop calination.eu between Maranti Media & Technologies, owner Ioannis Amarantidis, Schelmenreuteweg 25/4, 72766 Reutlingen, Germany (hereinafter "Calination" or "we") and the customer, in the version valid at the time of the order.

(2) A consumer is any natural person acting for purposes that are outside their trade, business, craft or profession (Art. 2(1) of Directive 2011/83/EU and the national laws implementing it). A business customer is any natural or legal person, or partnership with legal capacity, acting for purposes relating to their trade, business, craft or profession.

2. Conclusion of the contract, storage of the contract text

(1) The products presented in the online shop do not constitute a binding offer, but an invitation to place an order.

(2) By clicking the "Place order and pay" button, the customer submits a binding offer. Before submitting the order, the customer can correct their entries at any time using the browser's back function.

(3) The contract is concluded when we accept the order by sending an order confirmation by email within three working days. If you pay via a payment service provider (e.g. PayPal, Mollie), the contract is concluded when the payment process is completed.

(4) We store the contract text and send it to the customer by email together with these Terms and Conditions. Past orders can be viewed in the customer account.

(5) The language of the contract is English.

3. Subject matter of the contract and main characteristics of the products

The subject matter of the contract is the sale of goods. The main characteristics of the goods are set out in the respective product description. Personalised products (e.g. engravings) are made according to the customer's specifications.

4. Prices, delivery costs, delivery and payment

(1) All prices are total prices including VAT.

(2) Delivery costs are charged in addition. They depend on the delivery country and are listed on our Delivery & Payment page and shown in the cart and at checkout before you order. Delivery within Germany is free of charge.

(3) We ship from Germany with DHL, usually within 1 working day of receiving payment (personalised products within 1–2 working days). Delivery usually takes 3–8 working days, depending on the destination country (see Delivery & Payment). We deliver to the countries that can be selected at checkout. We do not deliver to the United Kingdom.

(4) Payment can be made by credit card (Visa, Mastercard, American Express), Apple Pay, Google Pay, MB WAY or Multibanco (for delivery to Portugal only), PayPal, Klarna or bank transfer (prepayment). The payment methods available for your delivery country are shown at checkout. If you pay by bank transfer (prepayment), please transfer the invoice amount to the account stated within 7 days; we ship your order once payment has been received.

(5) If a delivery fails for reasons for which the customer is responsible (e.g. an incorrect address or refusal to accept the parcel), the customer bears the resulting costs.

5. Right of retention, retention of title

(1) The customer may only exercise a right of retention in respect of claims arising from the same contractual relationship.

(2) The goods remain our property until they have been paid for in full.

6. Right to withdraw

(1) Consumers have a statutory right to withdraw. Details can be found in our Right of Withdrawal policy.

(2) No right to withdraw for personalised products. Under Art. 16(c) of Directive 2011/83/EU and the national provisions implementing it, there is no right to withdraw for contracts for the supply of goods that are made to the consumer's specifications or are clearly personalised. This applies in particular to all products that are engraved or printed with a text of the customer's choice at their request (e.g. engraved parallettes). We point out this exclusion clearly on the product page, in the cart and at checkout before the order is placed; the customer confirms that they have noted it before completing the order.

(3) The right to withdraw remains unaffected for any other, non-personalised items in the same order.

(4) The engraving or custom text is produced exactly as entered by the customer when ordering (including spelling, upper/lower case and special characters). Changes are only possible as long as production has not yet started; please contact us immediately by email, quoting your order number. We do not produce texts that are unlawful, offensive or infringe the rights of third parties; in that case, we will contact you.

7. Statutory rights in respect of faulty goods

(1) Your statutory rights apply. As a consumer, you have the rights under the consumer sales law of your country of habitual residence (implementing Directive (EU) 2019/771): the goods must conform to the contract – for example, they must match their description, be fit for purpose and have the quality and durability normal for goods of the same type. If the goods are not in conformity, you can ask us to repair or replace them, or to reduce the price or terminate the contract.

(2) We are liable for any lack of conformity that becomes apparent within at least two years of delivery. Where the law of your country of residence provides for a longer period (for example, three years in Portugal) or other additional rights, that law applies.

(3) For business customers, the warranty period for new goods is 12 months from delivery.

(4) Consumers are asked to check the goods on delivery for completeness, obvious defects and transport damage and to let us know about any problems as soon as possible. This request does not affect your statutory rights in any way.

8. Liability

(1) We are liable without limitation for damage resulting from injury to life, body or health, and in cases of intent and gross negligence.

(2) In the event of a slightly negligent breach of essential contractual obligations, our liability is limited to the damage typically foreseeable for this type of contract. Otherwise, liability for slight negligence is excluded.

(3) Liability under product liability legislation (Directive 85/374/EEC and the national laws implementing it, e.g. the German Product Liability Act) remains unaffected.

(4) Nothing in these terms excludes or limits our liability where this is not permitted by the mandatory consumer protection law of your country of habitual residence.

9. Notes on using the products

Our products are sports equipment. The customer is responsible for using them properly, observing the load limits and setting up their training safely. If you have any health restrictions, we recommend consulting a doctor before training.

10. Final provisions, governing law, dispute resolution

(1) The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). If you are a consumer, this choice of law only applies insofar as it does not deprive you of the protection afforded by the mandatory provisions of the law of the EU member state of your habitual residence (Art. 6(2) Rome I Regulation).

(2) As a consumer, you can bring proceedings against us in the courts of the place where you are domiciled, and we can only bring proceedings against you in those courts (Art. 18 Brussels Ia Regulation (EU) No 1215/2012). If the customer is a merchant, a legal entity under public law or a special fund under public law, the place of jurisdiction is our place of business.

(3) We are neither obliged nor willing to take part in dispute resolution proceedings before a consumer arbitration body. If you have a complaint, please contact us at info@calination.de. Consumers can get free advice on cross-border disputes from the European Consumer Centre in their country (ECC-Net).
